Sending a notice of claimed infringement

If you believe material on our service infringes a copyright you own or are authorized to act for, send our agent a written notice that includes:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you say is infringed, or a representative list if there are several.
  3. Identification of the material you say is infringing, with enough information for us to find it, such as the link to the page where it appears.
  4. Your name, mailing address, phone number and email address.
  5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

When we receive a notice that meets these requirements, we remove or disable access to the material promptly and let the user who posted it know.

Counter-notice

If material you posted was removed and you believe it was removed by mistake or misidentification, you may send our agent a counter-notice that includes:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which Measureable Media LLC may be found), and that you will accept service of process from the person who sent the original notice or that person's agent.

We will send a copy of a valid counter-notice to the person who sent the original notice. Unless that person tells us within 10 business days that they have filed a court action to stop the activity, we may restore the material 10 to 14 business days after we receive the counter-notice.

Repeat infringers

We end, in appropriate circumstances, the accounts of users who repeatedly infringe copyrights.

A person who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages under 17 U.S.C. § 512(f). If you are not sure whether material infringes your rights, consider speaking with a lawyer first.
